Terms of Service

These Terms of Service govern your use of tacticalmarketingpro.com and any services provided by Tactical Marketing Pro (“TMP,” “we,” or “us”). By using our site or engaging our services, you agree to these terms.

1. Services

Tactical Marketing Pro provides creative marketing services including web design, digital marketing, branding, print production, social media management, AI business solutions, and related services as described at tacticalmarketingpro.com/services. The specific scope, deliverables, and timeline for each engagement are defined in a written project proposal or service agreement.

2. Payment Terms

• ·Project work: All project engagements require a 50% deposit before work begins. The remaining balance is due upon project completion and before final file delivery.
• ·Monthly retainers: Retainer services (SEO, social media, SMS marketing, etc.) are billed monthly in advance. The first payment is due before service begins.
• ·Late payments: Invoices are due within 7 days of issuance. Accounts more than 14 days past due may result in a pause of service delivery.
• ·Refunds: Deposits are non-refundable once work has commenced. If TMP fails to deliver agreed deliverables, we will either complete the work or issue a partial refund at our discretion.

3. Client Responsibilities

To deliver on time and to spec, clients agree to:

• ·Provide accurate business information, brand assets, and content required for the project
• ·Respond to requests for feedback or approvals within 3 business days
• ·Maintain ownership of any accounts or platforms we access on your behalf
• ·Ensure all content provided to TMP does not violate third-party intellectual property rights

4. Deliverables and Intellectual Property

• ·Upon receipt of final payment, you receive full ownership of all final deliverables (logos, website files, design assets, etc.).
• ·TMP retains the right to display completed work in our portfolio unless you request otherwise in writing.
• ·Work-in-progress materials remain TMP's property until final payment is received.

5. Revisions

Each project proposal specifies the number of included revision rounds. Additional revisions beyond the agreed scope will be quoted and billed separately.

6. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the engagement. This obligation survives termination of the service relationship.

7. Website Use

You may use tacticalmarketingpro.com for lawful purposes only. You may not scrape, reproduce, or distribute site content without written permission. We reserve the right to block access to any user who misuses the site.

8. Limitation of Liability

To the maximum extent permitted by law, TMP's liability for any claim related to our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate an ongoing service engagement with 30 days' written notice. You are responsible for payment for all services rendered through the termination date. Deposits on project work are non-refundable upon termination.

10. Governing Law

These terms are governed by the laws of the State of Texas. Any disputes shall be resolved in Harris County, Texas.

11. Changes to These Terms

We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
